A bill described as "the first part of Gov. Brian Kemp's multiyear approach to tort reform," received a favorable Georgia House Insurance Committee reading on February 15.
"This is one of the first cases I'm aware of where a piece of technology designed to avoid a crash actually set one up," said plaintiff's attorney Joe Fried.
A crane operator had a side hustle for years before he was injured. However, the COVID-19 pandemic drove away both clients and profits from the gig in the months leading up to a debilitating injury.
'If you don't have the authorized treating physician's report releasing the person to full duty, then it's like a crapshoot,' Presiding Judge M. Yvette Miller said.
The court will decide whether insurers should be allowed to forgo updating the statute of limitation for claims in their policies if that information is included in later endorsements.
