The Georgia Office of Commissioner of Insurance and Safety Fire (OCI) published a bulletin announcing a change in FAIR plan member company tax filing requirements.Previously, the member companies received a refund for the tax paid for their portion of the Georgia Underwriting Association (GUA) premiums written and then would have to file with the OCI the amount on their Annual Premium Tax Return. From now on, GUA will file and pay taxes owed directly to OCI. Insurers should be aware to no longer include the tax associated with the FAIR plan on the GID-203-PT. If they included the amount on their Schedule T, they can list it as a negative on the GID-203-PT so it balances out to zero. Companies not in compliance may end up paying the tax twice. The bulletin can be found here.
