The Supreme Court of Colorado has ruled that the Eighth Amendment's prohibition on the government's imposition of "excessive fines" applies to fines levied on corporations by the Division of Workers' Compensation (DWC).
|The case
Dami Hospitality LLC, the owner-operator of a Denver motel employing between four and 10 people at any particular time, allowed its required workers' compensation coverage to lapse on or about July 1, 2005. Upon receiving notification of the lapse from the DWC, Dami conceded the violation and paid a corresponding settlement in June 2006.
