A small apology can go a long way—especially when it comes to Workers' Compensation disputes, Kahlil Day reports on WCI360.com, Web site of the Workers' Compensation Institute.

“Just as the mediation process empowers the parties to determine the outcome of a dispute, a skilled mediator and counsel will recognize, during mediation, when mindful recognition of harm sustained by one of the parties (typically the claimant), or actual apology will advance the resolution process” writes Day, a Florida Supreme Court certified, County, Circuit, Family, and Appellate mediator and a certified civil case mediator for the Federal District Court for the Middle District of Florida.

“The manner of the communication of the apology by the party or of the recognition that suffering has occurred is significant,” he continues. “In a workers' compensation mediation, acknowledgement by the carrier that a claimant has been frustrated by an interruption (or termination) in the providing of benefits during the dispute resolution process may lead to the ultimate resolution of the case.”
