Claims News Service, Jan. 30, 4:19 p.m. EST — The CPCU Society's Claims Interest Group will present a web seminar on Wednesday, Feb. 11, 2009, for claim professionals who are dealing with the issue of independent selection of counsel.

Specifically, the educational event with describe the distinction between the insured's right to independent counsel and its right to independently select counsel, under which the insurer relinquishes its right to select counsel and control the defense. Presenter Beth Culp, a partner with the law firm of Hinshaw and Culbertson who leads the firm's coverage practices, will lead the discussion.Seminar organizers said that by the end of the presentation, claim professionals will understand the distinction between the insured's right to independent counsel and their right to select their own counsel; determine when a reservation of rights letter should be sent; explore critical concepts such as legal estoppel and appropriate response to tender; and identify variations among jurisdictions on the issue of independent selection of counsel.
