Amidst all the tension in Washington over the country's financial crisis and bailout proposals, you might have missed the fact that the Americans with Disabilities Act Amendments Act of 2008–or ADAAA–moved through Congress swiftly and with strong bipartisan support, signed into law by President George W. Bush on Sept. 25, with the modifications effective Jan. 1, 2009.
The ADAAA changes the way courts will evaluate whether an individual is disabled for ADA purposes in several significant ways. As a result, human resources professionals, corporate counsel and risk managers face new workplace compliance issues.
The bill was supported by a broad coalition of civil rights groups, disability advocates and employer organizations.
