Will Risk Mgr. Faxes Hurt Silversteins Case?

The World Trade Center leaseholders effort to claim the Sept. 11 terrorist attack as two occurrences for the purpose of their $3.55 billion “per occurrence” policy may stumble on faxes sent by his own risk manager, some lawyers argue.

On Sept. 12, 2001, the day after the WTC attack, Larry Silversteins risk manager, Robert Strachan, reportedly had twice faxed to a government agency, pointing to the Willis Property form and its limited “occurrence” definition that would offer Mr. Silverstein only one insurance payment of $3.5 billion
