The Florida Office of Insurance Regulation (OIR) published a bulletin on the provisions provided by the Hurricane Helene emergency order. Florida Governor Ron DeSantis declared a state of emergency on September 23, 2024, in anticipation of Hurricane Helene, which gave the OIR commissioner the authority to issue Emergency Order 400385-24.

The order protects policyholders affected by the hurricane and applies to all insurers, HMOs, premium finance companies, surplus lines insurers, and other entities regulated by the OIR. Any policy provision or law that requires the insured to respond by a certain time limit shall have a grace period and that time limit is extended to November 26, 2024. This applies to any act that was to be performed on or after September 26, 2024.

From September 26, 2024, to November 26, 2024, insurers cannot cancel or non-renew a policy that covers property in one of the affected counties, unless requested by the policyholder. Any notice of cancellation issued or mailed 10 days before September 26, 2024, should be withdrawn and reissued after November 26, 2024.
