The Texas Windstorm Insurance Association (TWIA) has filed revised forms with the Texas Department of Insurance for approval. The forms being revised are the TWIA Commercial Policy and the TWIA Dwelling Policy.
The requested changes come following the passing of House Bill 3208, which amended Subsection 2210.204 of the Texas Insurance Code. The original form states that if the insured cancels the policy, the amount of any refund of the annual premium will be pro-rata. The new, revised form states that the TWIA will refund the unearned premium only if the cancellation is for one of the reasons listed in Insurance Code Subsection 2210.204, which are as follows:
|- Purchase of similar coverage in the voluntary market
- Sale of the insured property to an unrelated party
- Total loss of the insured property
- A determination by the association that the insured property is no longer insurable under the association's rules and procedures.
