In light of the historic wildfire that burned large portions of Maui and the need for insurers to process large volumes of claims, the insurance commissioner has authorized temporary assistance from nonresident independent adjusters to help handle the claims.

In order to work the claims, nonresident independent adjusters are required to:

  1. Provide a copy of the adjuster's current license in another state with licensing requirements similar to those found in Hawaii statute HRS § 431:9-222
  2. Within three working days of the start of work by a nonresident adjuster, the insurer, independent adjusting company or producer using the nonresident adjuster must provide on company letterhead to the commissioner:
    1.  The name of the nonresident adjuster,
    2.  The nonresident adjuster's Hawaii mailing and business addresses and phone numbers, and
    3.  The nonresident adjuster's permanent home and business addresses and phone numbers.

The insurance company, independent adjusting company or producer should use the Emergency Independent Adjuster form available here.

Those who violate the regulation that authorizes the use of independent nonresident adjusters shall be assessed a civil penalty up to $5,000 per violation. A full copy of the notice may be found here.
