I have an insured who had damage to their man-made koi ponds due to runoff from a fire on their building. The koi ponds need to rebuild because the liners cannot be reused. Is the koi pond business personal property (BPP) or is it real property covered under "other structures"? What resources do you have to support your position?

Your question is vague regarding the purpose of the pond in relation to the insured's business operations. That being said, we would look at the koi pond as no different from a coverage perspective than a swimming pool on commercial property. The koi pond would be considered an other structure under the building coverage, (2) fixtures, including outdoor fixtures. This is our expert opinion.
