On an AAIS FORM 3 (2.0) policy – This question is in regard to solar panels which supply electricity to the house but are free-standing in the yard and not affixed to the roof of the house. It is called a solar panel array. Our question is—Is there coverage under Coverage A or Coverage B or does it need to have separate coverage under an inland marine policy?

Coverage B is for related private structures on the premises that are not attached to "your" "residence". Structures attached only by a fence, utility line or similar connection are not considered attached, and are therefore covered under Coverage B. Solar panels would be a related private structure. When a term isn't defined in a policy courts turn to a standard desk reference as that is what is available to most insureds. Merriam Webster defines structure as: something (such as a building) that is constructed b: something arranged in a definite pattern of organization Solar panels are structures as they are built. Other structures often found on residential property that fall under coverage B are gazebos, swing sets, swimming pools, and detached patios. A structure does not have to have walls and a roof, it is simply something constructed. As the solar panels are constructed and are detached from the dwelling, they fall under Coverage B.
