On January 10, 2022, the Florida Office of Insurance Regulation (FLOIR) issued a memorandum notifying residential property insurers—both personal and commercial—who do or are authorized to do business in Florida of new litigation reporting requirements in line with Senate Bill 76 (now Chapter 2021-77), which was signed into law by Governor DeSantis in June 2021.

The Bill, which became effective on July 1, 2021, prescribes the manner in which insurers must file information concerning both individual and group claims resolved during the previous reporting period. This filing must be completed annually on a form prescribed by the Financial Services Commission, with the first anticipated due date to take place in the first quarter of 2023. The specific information that must be included in the new filing is found in Fla. Stat. §624.424(11).
