Bed Bug Laws for Landlords – Tenants

In recent years bed bugs have reared their ugly heads in hotels, residences, and even movie theaters. This chart outlines state requirements that landlords must abide by when renting property to tenants.

Within five days of a tenant's report of suspected bedbugs, the landlord or pest control company representative shall visually inspect for bedbugs. Within ten days of finding evidence of bedbugs, the landlord shall start the infestation control process.

The presence of bedbugs in any place where sleeping accommodations are offered to the public is declared a public nuisances dangerous to the public health.

California

The law requires a langlord to provide a prospective tenant information about bed bugs, as specified. The law requires that the landlord provide notice to the tenants of those units inspected by the pest control operator of the pest control operator's findings within two business days, as specified. The law prohibits a landlord from showing, renting, or leasing a vacant dwelling unit that the landlord knows has a bed bug infestation, as specified.

Colorado

No more than ninety-six hours after receiving notice of the possibility of bedbugs, a landlord shall both obtain an inspection of the unit by a qualified inspector and may enter any contiguous dwelling for an inspection. If such inspection confirms the presence of bedbugs, the landlord shall inspect all contiguous units as promptly as is reasonably practicable.

Connecticut

Establishes a framework to identify and treat bed bug infestations in residential rental properties, including public housing but excluding detached, single-family homes. It sets separate duties and responsibilities for landlords and tenants, including notice, inspection, and treatment requirements. It also gives landlords and tenants remedies when either party fails to comply with these duties and responsibilities.

No more than three days after obtaining an inspection, the landlord shall commence reasonable measures to effectively treat the presence of bedbugs, including retaining services from a licensed pest control professional to treat the dwelling unit and any contiguous units. Requires county infirmaries to implement procedures to prevent and treat bedbug infestations.

New Hampshire

No Landlord shall rent the premises if it is infested by bed bugs and the landlord is not conducting a periodic inspection and remediation program. In this paragraph "remediation" means action taken by the landlord that substantially reduces the presence of bed bugs in a dwelling unit for a period of at least sixty days. "Infestation of bed bugs" means the presence of bed bugs in real property rented for residential purposes. Landlords are to investigate tenant reports of bed bugs and are allowed entry in order to inspect the premises for bed bugs.

New Jersey

Every owner of a dwelling containing two or more dwelling units, whether occupied or unoccupied, shall be responsible for the extermination of insects, rodents, vermin, or other pests on the premises. The owner's responsibility to exterminate will be triggered upon receipt of a letter from the tenant stating the presence an description of the infestation and requesting extermination. As appropriate, but especially where the presence of bedbugs has been established, the owner shall treat (1) the two units on either side of the affected unit, (2) the units directly above and below the affected unit, and (3) the two units on either side of the units above and below the affected unit, for a total of nine units. A building owner is responsible to provide extermination service by a certified exterminator for bedbugs as many times as necessary to totally eliminate the reported bedbug problem. Once the problem is eradicated, the building owner is not responsible to provide treatments if a new bedbug problem arises with the same tenant during the remainder of the current calendar year.

For housing accommodations subject to this code, an owner shall furnish to each tenant signing a vacancy lease, a notice in a form promulgated or approved by the state division of housing and community renewal that sets forth the property's bedbug infestation history for the previous year regarding the premises rented by the tenant and the building in which the premises are located. A report shall be made annually to the state that includes not only street address and number of dwelling units but number of units that had a bed bug infestation, number of units where eradication measures were used, and number of units where an infestation existed after eradication measures were used.
