Racing Activities Covered under Personal Auto Policy?

One of our insureds takes his street model automobile to the local racetrack on weekends to engage in racing events. Would today's personal auto policy respond to either liability or physical damage claims arising out of this activity?

Under previous versions of the personal auto policy, both liability and physical damage coverage might have applied. However, the current version of the personal auto policy (PAP) has a racing exclusion that applies to the liability coverage, the medical payments coverage, and the physical damage coverage. That exclusion states that coverage does not apply to “any vehicle, located inside a facility designed for racing, for the purpose of competing in or practicing or preparing for any prearranged or organized racing or speed contest.” Clearly, in this instance, your insured's PAP will not apply to any liability or physical damage claims that may arise.

Note, however, that based on the wording of the racing exclusion,  presumably if your insured engaged in a race on a highway or on some road outside a “facility designed for racing,” the PAP would provide coverage for the claims.
