Volunteer as an Insured
August 31, 2015
Can a volunteer worker recover bodily injury damages under a CGL policy given the fact that by definition he is considered an insured?
The injuries occurred while the volunteer was performing duties for the name insured.

The answer is yes. Due to the separation of insureds clause, each insured is considered as a separate entity, so for example, if the named insured is responsible for injuring a volunteer, the volunteer can seek damages from the named insured. There is no exclusion to prevent such coverage. Also, an insured is eligible for med pay.
