Property in Transit Coverage on the BOP

The insured was having a package shipped to them, and it was damaged in transit.

The coverage extensions states that coverage applies to property located in or on the building listed in the declaration or in the open (or in a vehicle) within 100 feet of the premises. This insured has a coverage extension to increase the distance to 1,000 feet.

The personal property off premises coverage extension provides coverage while covered property is in the course of transit or at a premises the insured does not own, lease, or operate.

It would seem that when property is in transit—for example, en route to a trade show—it will likely almost always be more than 1,000 from the described building.

The Businessowners Coverage Guide [a National Underwriter publication] talks about the coverage territory and property being shipped from California to Hawaii. Can you clarify this discussion and how it relates to property more than 1,000 feet from the premises and in transit?

In the ISO BP 00 03, the lead-in language to the coverage extensions states that except as otherwise provided, the extensions apply to property within 100 feet (or in your case, 1,000 feet) of the described premises. The personal property off premises extension states that property is covered while in transit or at a premises the insured does not own, lease, or operate. This would fit under the “except as otherwise provided” description since, as you note, property in transit is probably going to be more than 100 feet away from the premises. The discussion of property shipped from California to Hawaii comes in when talking about coverage for property in transit while it is in between points in the coverage territory. Property while in transit between California and Hawaii would be covered because those are both points within the coverage territory. Property shipped from California to Mexico would not be covered because Mexico is not part of the coverage territory.
