Road Damage to Tires Exclusion

Our insured slid on wet pavement and struck a curb. As a result, the tire was the only part damaged. Does the road damage to tires exclusion in the personal auto policy apply?

That would be a very strict reading of the exclusion. The exclusion is meant to apply to damage caused by the road itself. In this instance, the damage was caused by sliding into and colliding with a curb so we are of the opinion that this is a collision loss and the exclusion does not apply.
