Inflatable Bounce Apparatus and Vandalism
December 22, 2014
Our client's business uses an inflatable bounce apparatus that kids play in. The inflatable sprung a leak, which the insured promptly repaired. In due course the repair patch started to lift and one of the kids then tore it off, causing a greater tear in the material of the bounce apparatus so that it can no longer be repaired. Is this new tear covered under vandalism provisions of the insurance or any other provisions?

The cause of loss would not be considered vandalism. Vandalism requires malicious intent, so unless it can be shown that the kids intended to damage the apparatus, it would not be vandalism. This sounds like a case of wear and tear, which would be excluded.
