Loss of Consortium

An insured has 50/100 BI coverage and is involved in an “at fault” accident. The claimant claims $50,000 in BI damages and his wife sues for “loss of consortium” in the amount of $25,000. Will the insured's policy pay $50,000 or $75,000? Would this be considered a multiple injury claim?

The insured's policy will pay $50,000, unless the insured's wife can herself claim bodily injury. “Bodily injury” is a defined term in the personal auto policy. It means “bodily harm, sickness or disease, including death that results.” This does not include a claim for loss of consortium.
