Fluids Damage Assisted Living Facility
January 7, 2014
Our insured had a HO 4 policy (04/91) policy. Our insured is a tenant at an assisted living facility. Our insured had a medical emergency and bodily fluids damaged the carpet. The building's management company sent a bill for coverage as a liability claim. Would there be coverage for this claim?

Liability coverage applies when an insured is legally liable for the damage, something to be determined by the courts. This is definitely an accidental incident. There is coverage of $500 under the additional coverage of damage to property of others; however I wonder why the assisted living center's property damage isn't covering this directly. It seems like this is something that would be expected at such facilities.
