Collision Definition under Property Form

We have a question regarding the following item in the CP 10 30 10 12:

F Additional Coverage Extensions

1. Property in Transit

b. (2) Vehicle collision, upset or overturn. Collision means accidental contact of your vehicle with another vehicle or object. It does not mean your vehicle's contact with the roadbed.

What does the last sentence mean: “It does not mean your vehicle's contact with the roadbed”? I am not understanding this reference. One would think that could mean overturn of a vehicle, however that is specifically listed in the first sentence.

The sentence you reference is a clarification that, in order for a collision to occur, the insured's vehicle must collide with another vehicle or an object. Colliding with the roadbed could be a situation where the vehicle is damaged by hitting a pothole. It may not be upset or overturn in this case, but it also did not hit another vehicle or object. In that situation, the additional coverage would not apply.

 

Under the Personal Auto Policy, collision with a road bed can be considered a collision loss, so this item in the property form clarifies that the property form is not going along with how some courts interpret such a loss under the PAP.
