Vacant Land Definition

We have a question about vacant land on an HO-3 policy. Our insured co-owns 15 acres of land with his brother. The land is not used for farming but it has a fence around it and an asphalt road on it for access to their land and some adjacent land. Does the fence or paved road make it so this land does not meet the definition of insured location? 6. "Insured location" means: a. The "residence premises"; e. Vacant land, other than farm land, owned by or rented to an "insured";

Vacant is defined as being without occupant or content. While the land is not being used, it does contain structures, the fence and the road. Therefore, the land is not vacant, so an endorsement is needed.
