Our insured recently went into their attic and discovered mold. They have a pull-down staircase to access the attic, but claim that they never go into the attic.
Would this fit the definition of "unknown to all 'insureds' and is hidden within the walls or ceilings or beneath the floors or above the ceilings of a structure?"
Connecticut Subscriber
Unfortunately, not going into the attic is not the same thing as mold being hidden behind a wall or ceiling. That is unknown because without tearing out the wall or ceiling it is inaccessible. Simply not going into the attic is not the same thing. The insured had access, he just chose not to use it. The loss is not covered.
