Missing Property with No Proof of How It Disappeared Excluded
A tenant was in place at the insured location when the insured purchased the building. The tenant vacated the building when his relationship with the landlord broke down. The insured noticed property missing after the tenant left. There was no forced entry to the building. We assume that the tenant took equipment when he vacated, but the insured cannot prove it. The insured also cannot prove the equipment was purchased with the building.
Would exclusion h. of the C P 10 30 form apply regarding “or to anyone whom you entrust the property for any purpose”?
Pennsylvania Subscriber
The exclusion you reference does not apply in this situation, but limitation C. 1.e. “Property that is missing…where there is no physical evidence to show what happened to the property” would apply.
