ATV Included in Property Not Covered Clauses

January 10, 2012

Under the Building and Personal Property Coverage form, CP 00 10 04 02, in the property not covered section, p. vehicles or self-propelled machines (including aircraft or watercraft), would an ATV be considered a vehicle or self propelled machine?
If an insured has a customer's ATV in his care, custody, and control for work to be performed on the ATV, would that be considered a vehicle or self-propelled machine the insured processes?

Yes, an ATV would be considered a self-propelled machine. As it belongs to a customer, it is assumed that it is operated primarily away from the premises, so it would fit one of the other criterion required for a vehicle to be considered property not covered.

While the insured repaired the ATV, that is not the same as processing. Processing would be something performed on the vehicle in the course of manufacturing. So, the exception would not apply to this vehicle.
