Additional Insured Coverage for Officers

October 17, 2011

If an additional insured scheduled on the CG 20 26, Additional Insured – Designated Person or Organization Endorsement, is a corporation, are the officers of that corporation personally insured under this additional insured endorsement?

After reading the AI endorsement and the CGL form, who is an insured clause, we are of the opinion that the AI coverage is for the corporation only. The endorsement allows for persons and organizations to be scheduled, so if the officers of the corporation were intended to be covered as AIs, then they should be listed in the schedule; just listing the corporation means just that, the corporation is intended to be covered as an AI and no other entity.  Also, the CGL form considers corporations as insureds, but officers and directors are included only with respect to their duties as officers or directors. In other words, the CGL form does not give personal liability coverage to the officers and directors, it only provides general liability coverage for them in their capacity as officers and directors of the named insured corporation. An additional insured endorsement is not going to expand on that extent of coverage.
