State-By-State Summary
Summary: Just as the various states have different requirements for automobile liability coverage, they also have different requirements concerning uninsured motorists (UM) coverage. This treatment presents a state-by-state examination of uninsured motorists regulations. Citations to the various states' codes are listed below the state name. If an issue is not addressed in the code but has been decided in court, the legal citation for the case is given. For a detailed discussion of uninsured motorists coverage, please see [IDL:Personal Auto Policy—Part C ] .The treatment answers the following questions on a state-by-state basis:
1. Statutory reference.
2. Are automobile insurance policies required to include UM coverage?
3. May the coverage be rejected? If so, what is the procedure? If the wording for the rejection is prescribed in the state code, the wording is quoted.
4. Must UM limits equal the liability limits?
5. Is an insured required to sign-off on lower limits?
6. Is uninsured motorists-property damage (UMPD) coverage required to be offered?
7. Is underinsured motorists coverage (UIM) treated separately from UM?
8. Is stacking of limits permitted?
9. How does the law treat a hit-and-run vehicle? Is physical contact required, before a claim may be made under UM?
10. Are umbrella policies required to cover the UM exposure?
11. Miscellaneous provisions.

1. Statutory reference: AL ST § 32-7-23.
2. Required? Yes.
3. Rejection Allowed? Yes. Once rejected, the insurer does not have to obtain a new rejection at each renewal.
4. Must UM Equal BI? No.
5. Sign-Off Required? No statutory reference.
6. Must UMPD be Offered ? No.
7. UIM separate from UM? No distinction is made between UM and UIM.
Underinsured motorist coverage applies only when the sum of the limits of liability under all BI liability bonds and insurance policies—that are available to an injured person after an accident—is less than the damages which the injured person is legally entitled to recover. Alabama Ins. Guar. Ass'n v. Hamm , 601 So. 2d 419 (Ala. 1992).
8. Stacking permitted? Yes—among cars on the same policy—up to two additional cars, but not between cars on multiple policies. However, where an insurer issues policies that only cover one car each, any number of those policies may be stacked. State Farm Mut. Auto. Ins. Co. v. Fox , 541 So. 2d 1070 (Ala. 1989).
9. Physical Contact? No physical contact required. It used to be required that the injured driver must be able to “prove that the accident did in fact occur and that he or she was injured as a proximate result of the negligence of such other motorist, who cannot respond in damages for such injuries, including the unknown or hit-and-run driver.” However, that requirement has been deemed as contrary to state law. Walker v. GuideOne Specialty Mutual Insurance Company, 834 So.2d 769 (Ala. 2002).
10. Must Umbrellas Cover? No. Sweatt v. Great American Ins. Co. , 574 So. 2d 732 (Ala. 1990).
11. Miscellaneous Provisions: The provision that eliminates coverage for injuries caused by a government-owned auto does not apply in Alabama. Higgins v. Nationwide Mut. Ins. Co. , 282 So. 2d 295 (Ala. 1973).
Another case—State Farm Auto Ins. Co. v. Reaves , 292 So. 2d 95 (Ala. 1974)—held two other provisions unenforceable in Alabama:
1. Driving a vehicle other than the one listed in the policy.
2. Driving a vehicle owned by a member of the household.
These exclusions are unenforceable to the extent that there is other liability coverage available to the injured party.
An unborn child who is subsequently born alive is an insured for the purposes of uninsured motorist coverage. Alabama Farm Bureau Mut. Cas . Ins. Co. v. Pigott , 393 So. 2d 1379 (Ala. 1981).
2. Required? Yes.
3. Rejection Allowed? Yes, in writing. Once rejected, the insurer does not have to obtain a new rejection at each renewal.
4. Must UM Equal BI? No, but such limits must be offered.
5. Sign-Off Required? Yes.
6. Must UMPD be Offered ? It is automatically included. The statute calls for a UMPD deductible of $250, however it allows an insurer to offer deductibles in other amounts. UMPD covers only direct damage to a vehicle—not loss of use.
7. UIM separate from UM? No distinction between UM and UIM. UIM is triggered if the limits on the at-fault party's policy are lower than the insured's UIM limits. Colonial Ins. Co. v. Tumbleson , 889 F. Supp. 1136 (D.Alas. 1995).
8. Stacking permitted? No.
9. Physical Contact? Contact is required. A police report is also required within 24 hours, if the other party leaves the scene.
10. Must Umbrellas Cover? No. See Alaska Statute 21.89.020 (i).
2. Required? No, but must be offered.
3. Rejection Allowed? Yes.
4. Must UM Equal BI? Yes.
5. Sign-Off Required? Yes.
6. Must UMPD be Offered ? No.
7. UIM separate from UM? Yes. UIM is collectible when the insured's total damages exceed the limits of liability available from the wrongdoer.
8. Stacking permitted? No.
9. Physical Contact? Yes, unless claimant's description of the accident can be corroborated. In Lowing v. Allstate Ins. Co., 859 P.2d 724 (Ariz. 1993), the court said that “the legislature specifically intended this section to cover the unidentified motorist.”
10. Must Umbrellas Cover? No.
11. Miscellaneous: UM and UIM do not apply to punitive damages. State Farm Mut. Auto. Ins. Co. v. Wilson , 782 P.2d 727 (Ariz. 1989).
The provision that eliminates coverage for injuries caused by a government-owned auto does not apply in Arizona. McClellan v. Sentry Indem. Co. , 683 P.2d 757 (Ariz. App. 1984).
The “owned but not insured” exclusion does not apply in Arizona. Calvert v. Farmers Ins. Co., 697 P.2d 684 (Ariz. 1985).
A wrongful death claim may be made in Arizona by a surviving insured under the same policy. If there are no surviving insureds, the estate of the deceased may bring the action.
2. Required? Yes.
3. Rejection Allowed? Yes, in writing. However, a new rejection must be signed for additional or substitute vehicles. Lucky v. Equity Mut. Ins. Co. , 537 S.W.2d 160 (Ark. 1976).
4. Must UM Equal BI? No, but UM may not be less than the state minimum financial responsibility requirements. If the insured purchases BI limits above the state minimums, the insurer must “have available, upon written request of a named insured or applicant, coverage. . .in limits up to his or her third-party liability limits.”
5. Sign-Off Required? No statutory reference.
6. Must UMPD be Offered ? Yes, with a $200 deductible.
7. UIM separate from UM? Yes.

Supp. 384 (E.D.Ark. 1968), a court ruled that the provision that eliminates coverage for injuries caused by a government-owned auto does not apply in Arkansas. However, that provision still appears on the Arkansas UM endorsement.
2. Required? Yes.
3. Rejection Allowed? Yes, in writing. The form must be worded: “The California Insurance Code requires an insurer to provide uninsured motorists coverage in each bodily injury liability insurance policy it issues covering liability arising out of the ownership, maintenance, or use of a motor vehicle. Those provisions also permit the insurer and the applicant to delete the coverage completely or to delete the coverage when a motor vehicle is operated by a natural person or persons designated by name. Uninsured motorists coverage insures the insured, his or her heirs, or legal representatives for all sums within the limits established by law, which the person or persons are legally entitled to recover as damages for bodily injury, including any resulting sickness, disease, or death, to the insured from the owner or operator of an uninsured motor vehicle not owned or operated by the insured or a resident of the same household. 3. Rejection Allowed? Yes, in writing.
4. Must UM Equal BI? No.
