Leased Hunting Land—How to Insure?

Our question concerns a group of people who individually lease acreage for hunting purposes on a seasonal basis (4 months). There is a hunting camp on the premises. Can the personal liability exposure be covered by endorsing the homeowners policy with the "additional premises occupied by the insured" endorsement? We are concerned about liability to guests who might be injured at the camp or while hunting.

Many of us believe that the homeowners policy, with the addition of a personal umbrella policy, would provide the necessary coverage, but we would like your opinion on the matter.

Unless the homeowners policy is supplemented, as you suggested, by the insured's purchase of liability coverage for this secondary location, it will not respond to the situation you describe. Some companies add this coverage by endorsement, others require a notation on the declarations page. This supplemental coverage is needed because the leased land does not qualify as an "insured location." Although an insured location may include "any part of any premises occasionally rented to an insured for other than business use," the land in this case is not rented to the individuals on an occasional basis, even if it is used only occasionally by them.

 

If the supplemental coverage is purchased, all the homeowners policies would respond if the members of the group were sued individually, although coverage would be prorated by face amounts. Any personal umbrellas would probably respond in the same way.

Obviously, such an arrangement would cause many headaches, so it might be worthwhile for the group to see if an insurer is willing to write a commercial general liability policy in the group's name.
