Personal Excess Liability Policy

The notes that follow point out what the editors believe to be the most significant features of the Metropolitan Property & Casualty Personal Excess Liability policy. For full details, the actual policy provisions should be examined. See Personal Umbrella Liability Insurance for a general discussion of personal umbrella liability insurance.

1.     Available Limits: $500,000; $1 million; and $2 million ($3 million and $5 million refer to company).

2.     Underlying Insurance: Automobile (including autos, pickup trucks, and vans): $100/300/50 (250/500/100 if underlying is not provided by Metropolitan). Property owners: $100,000 ($300,000 CSL if underlying is not provided by Metropolitan). Watercraft: $100/300/50 ($300,000 CSL if underlying is not provided by Metropolitan).

3.     Personal Injury Definition: Defined as bodily injury, sickness, disease or disability, false arrest, detention or imprisonment, malicious prosecution, libel, slander, or defamation of character, invasion of privacy, wrongful eviction or wrongful entry, or mental anguish.

     Personal injury does not include the transmission to or by the insured of any disease, bacteria, parasite, virus, or other organism or the actual, alleged, or threatened sexual molestation of a person,

4.     Intentional Acts: There is no coverage for personal injury or property damage resulting from any act committed by or at the direction of any insured.

5.     Insured Persons: Named insured, spouse and resident relatives; or, any person using, with the named insured's permission, an auto, pleasure vehicle, or boat owned, rented by, or loaned to the named insured provided it is furnished for their regular use,

6.     Automobiles: Defined as a land motor vehicle, recreational motor vehicle, motorcycle, trailer, or semi-trailer, including attached machinery or apparatus.

     Property damage or personal injury arising out of the use of a non-owned auto hired by the insured for less than twelve months is excluded unless covered by an underlying policy or by other valid and collectible insurance.

     Commercial risks (including artisan vehicles) or drivers who have had a license or registration suspended, revoked, or refused, or have had a major conviction of any type with the past five years are ineligible. Also ineligible are risks with two or more at-fault accidents or moving violations per household in the past three years (regardless of where insured).

7.     Aircraft and Watercraft: Aircraft are ineligible as are power boats used for racing, charter, tournament, fishing, or towing parasails, gliders or kites. High performance and personal watercraft (including jet skis, wet bikes, and power skis) are also ineligible.

     Additional or newly acquired watercraft must be reported within thirty days even if covered by underlying insurance.

8.     Insured Locations: No restrictions.

9.     Business Property and Pursuits: Business property and business pursuits are excluded unless covered by an underlying policy. Professional services are flatly excluded.

     Day care operations are ineligible.

10.     Care, Custody, Control: Damage to property of any insured is excluded.

11.     Other Notable Features: Other ineligible risks include: dangerous or aggressive animals; any risk who has been or is being sued for libel, slander, or defamation or applicants “engaged in activities that tend to produce excessive risk associated with these perils;” high performance watercraft, snowmobiles, or RVs; and farms including machinery, equipment and livestock.
