Personal Umbrella Liability Endorsement

The notes that follow point out what the editors believe to be the most significant features of Cincinnati Financial Corporation's Personal Umbrella Liability Endorsement. 1.     Available Limits: $1 to $10 million.

2.     Underlying Insurance: varies by state and whether or not Cincinnati Financial Corp. underwrites the underlying coverages.

3.     Personal Injury Definition: a. “bodily harm or injury, sickness, disease, disability, shock fright, mental anguish or mental injury to others including care, loss of services or death arising out of any of these that is caused by an occurrence;” b. “libel, slander, defamation of character, false arrest, willful or false detention or imprisonment, wrongful eviction or entry, malicious prosecution, humiliation, or invasion of privacy;” c. assault and battery, but only if committed to protect persons or property.”

     Personal injury arising from the transmission of communicable diseases by the insured or resident relatives is excluded.

4.     Intentional Acts: There is no coverage for bodily injury or damage which may be reasonably expected or intended by an insured “even if the personal injury or property damage is of a different degree or type than actually expected or intended.”

5.     Insured Persons: For occurrences other than the use of automobiles: named insured and spouse, resident relatives, and any other person under the age of 21 if in the care of named insured, spouse or resident relative; any person or organization using or having custody of pets which you or your relatives own, with your permission; and any person other those just described if they are an insured in the basic policy.

     For occurrences caused by the use of automobiles: the insured and resident relatives are covered for autos owned, leased, or rented as well as for permissive use of autos borrowed or used; any person for permissive use of autos owned by the insured or a resident relative; and any person or organization legally responsible for the use of an auto if used by the insured or with the insured's permission.

     Owners or lessees, other than the named insured, of borrowed, leased, or rented autos or their agents or employees are not insureds unless covered by the basic policy and then only for hazards covered by that policy. Likewise, “any person or organization while employed or engaged in the business of selling, servicing, repairing, maintaining, parking, or storing of autos is not an insured.”

6.     Automobiles: Coverage is excluded for “the use of vehicles or boats in racing events, whether or not organized, except as covered by primary insurance. This exclusion also applies to practicing for a race.”

7.     Aircraft and Watercraft: All aircraft liability is excluded. The use of “boats in racing events, whether or not organized, except as covered by primary insurance, is excluded. This exclusion also applies to practicing for a race.” There is a thirty-day “grace period” for the acquisition of boats. Primary insurance with the required minimum limits shown on the Declarations page must be secured.

8.     Insured Locations: No restrictions.

9.     Business Property and Pursuits: Policy excludes business pursuits and business property of an insured unless covered by primary insurance. The exclusion does not apply to the ownership, maintenance or use of any auto.

10.     Care, Custody, Control: Property of a “covered person” is not covered. Damage to aircraft owned by or in the care, custody, or control of the insured is not covered. Coverage is not provided for damage to other property “used by, rented to, or in the insured's care, custody or control, to the extent that the covered person is obligated by contract to provide insurance for that property.”

11.     Other Notable Features: Underlying auto policy must be provided by Amica.
