Med Pay Question Regarding Injured Claimant
Does the medical payments coverage under the CGL form apply to someone who faints and falls to the floor causing an injury?
Kentucky Subscriber
Med pay is not based on the fault of the insured. The payments are made regardless of the fault of the insured. As long as the injury occurs on the premises of the named insured or because of the operations of the named insured, the CGL form will pay. Of course, there are exclusions to consider, but if none of them apply in this instance, the med pay coverage is there.
