Towing Expenses after a Collision Loss

Our insured had an auto accident in Florida and then had the truck transported to his company headquarters in Arkansas to be repaired. The cost of this transportation was about $4,000. The insurer said that it only owed for the cost to transport the truck to the nearest place from the point of the accident for the repair work. This would have cost about $600. Naturally, the insured is upset with this decision. What is your opinion?

Under the physical damage coverage section of the business auto policy, the insurer has the option of choosing the method of loss payment. If the chosen option is to repair the damaged property, then the most the insurer agrees to pay is the cost of repair with property of like kind and quality. The insuring agreement is to pay for the repair work and not to transport the covered auto miles and miles away from the loss site. This would unnecessarily add to the cost of the claim.

The BAP has towing coverage, but it is for the limit shown in the declarations and is for a covered auto of the private passenger type. So, even if the damaged vehicle was a private passenger type auto, the most the insurer would pay is the listed amount. If the listed amount is not $4,000, the insured would not be entitled to that amount.

An insured's duty after a loss is to make no payment or incur any expense without the consent of the insurer, except at the insured's own cost. By transporting his covered auto from Florida to Arkansas , the insured incurred an expense without the consent of the insurer and he has to accept this cost as his own.
