Tire Damage Due to Skidding

We are asking about the issue of tires that are damaged as a result of an emergency stop. There was a subsequent rollover and damage done to the vehicle, but the tires were not damaged in the rollover. The tires were damaged as a result of the skidding and can't be used anymore. Now, the business auto policy excludes coverage for loss caused by road damage to tires and the insurer is claiming that the tire damage was caused by “road damage.” The insured is disputing that point. May we have your opinion on this?

It is our opinion that the insurer is correct in its interpretation of the exclusion. The tires were damaged as a result of skidding on the road; the surface of the road damaged the tires by grating against the tires. This is like wear and tear, but on a much faster pace instead of happening over a period of time.
The exclusion on the auto policy does state that loss to tires is covered if caused by an “other loss that is covered by this insurance.” So, the insured may be seeing this as a loss caused by a comprehensive cause of loss, since that category includes “any cause,” except collision or overturn. However, as comprehensive as that category is, it is limited by the exclusions. In this case, the road damage to tires exclusion precludes even comprehensive coverage for loss to the tires.
