We are handling a burglary loss under: CP 00 30 06 95 and CP 10 30 06 95. The insured has requested reimbursement of payroll for the time her manager spent with police. The burglary occurred prior to business hours, and it is our understanding the business was never shut down and there was no period of restoration. Accordingly, would the payroll for the manager's extra after hours work be considered a covered loss under this form?

The payroll for the manager's extra hours work would not be covered by this form because it does not meet the criteria described in the insuring agreement: "We will pay for the actual loss of Business Income you sustain due to the necessary suspension of your 'operations' during the 'period of restoration.'" Since operations were not suspended, this does not qualify as a business income loss under the form. It also would not qualify as an extra expense because extra expenses must be incurred during the period of restoration.
