Vehicle Peril—Motorcycle “Leathers” Covered

Q

Our homeowners insured was forced off the road by an oncoming auto while operating his motorcycle. There was no actual contact with the other vehicle, but our insured lost control and skidded on the highway. The insured suffered damage of approximately $625 to his leather clothing.

Does the vehicles peril provide coverage for the insured's leather clothing?

A

Yes, the vehicles peril covers the damage suffered by the insured. Since he was driving a vehicle at the time that the accident occurred, whether or not another vehicle was involved is not important. As illustrated by the court cases described in the Misc. Property section of the print FC&S, coverage for damage by vehicles is very broad because the peril has no limiting language.
