Med Pay for Off-Premises Consumption of Food

Medical payments coverage is specifically excluded under the CGL form for food consumed off-premises. How is this exclusion treated if the policy is endorsed with CG 24 07, products/completed operations hazard redefined endorsement? Will med pay then apply for food consumed on and off-premises?

Based on the exclusionary language under med pay for bodily injury included within the products-completed operations hazard, the fact that CG 24 07 has replaced the definition of products-completed operations hazard so that it now includes bodily injury that occurs after the named insured has relinquished possession of the product, we say that there is no med pay coverage for on or off-premises consumption of food.

Keep in mind that CG 24 07 only changes paragraph a. of the products-completed operations hazard definition. Paragraph b. remains, so if the liability classification code for the insured states that products-completed operations are subject to the general aggregate limit of the CGL form, then bodily injury is not going to be included in the products-completed operations hazard. If that is the case with your insured, the exclusion under med pay is not going to apply.
