Deductible and Hail Damage Loss

We insure a building with a CP 00 10 Building and Personal Property Form and CP 10 30 Cause of Loss form. In 2004 the building suffered hail damage, however our inspection at that time did not reveal any hail damage to the roof, only the AC condensing coil. A week ago the insured had a claim for interior water leaks due to melting snow. The adjuster reinspected and found evidence of hail. We are sure the hail stems from the same 2004 loss and is now apparent due to weathering. The adjuster also feels the roof is leaking because of the hail damage that is present from 2004.

We feel another deductible will apply for the interior water damage that occurred in 2007. The insured argues that but for the hail damage that we missed, this roof would not have leaked in 2007 and only one deductible should apply, that being the one we already applied to the 2004 loss.
