PD Coverage under BAP For Insured on Out of Country Business Trip?
We insure a business auto policy, and an insured rents a vehicle in his own name while on a business trip in England . The insured is involved in a loss in which he is liable, so we are checking to see if there would there be PD coverage under symbols 7, 8, 9 for liability. No claim or suit has been brought by the 3rd party directly or through his insurance carrier yet, so we wanted to find out if this would meet the term “suit” under Section 7 (coverage territory), subsection “e” ? Thanks.

As long as the insured's responsibility to pay damages is determined in a lawsuit filed in the US, Puerto Rico, or Canada, the coverage territory requirement is met. So, if the damaged party files a lawsuit in England , that is not going to be covered by the BAP as an accident occurring in the coverage territory. If the damaged party files a lawsuit in New York or Pennsylvania or where the insured lives in the US , that fits the covered territory requirement regardless of where the accident occurred.
