Business Auto Coverage for Rented Vehicle

Our insured has symbol 7 on his business auto policy (BAP) for both collision and comprehensive coverages. The insured rented a vehicle recently on a trip and got into an accident. There is damage to the rental vehicle. Does the BAP cover the physical damage to the rental vehicle or does the insured need a different symbol to extend coverage for rentals?

Symbol 7 under the BAP is for specifically described autos, autos that are described in the declarations of the policy. Unless the rented car is specifically described in the declarations, it is not a covered auto and physical damage coverage applies to loss to a covered auto. The insured has no coverage in this instance.

The BAP will not provide any liability coverage for the insured either. The care, custody, or control exclusion in the liability coverage section of the BAP applies to property damage to property in the insured's care, custody, or control.

The insured can consider using symbol 8 (hired autos) in the future in the event he continues to rent cars on business trips. Symbol 8 describes covered autos as those autos that the named insured leases, hires, rents, or borrows, and if an insurer will allow the use of symbol 8 for physical damage coverage, that symbol will extend coverage to rental vehicles for the insured. Or, the insured might want to consider his personal auto policy (PAP). That policy provides coverage for physical damage loss to nonowned autos, and that includes rented autos which are autos that are not furnished or available for the regular use of the named insured. Of course, that is standard PAP language, so you may want to check the insured's PAP to see exactly what it says about coverage for damage to rented cars.
